Ainae Music: Terms of Service

These Terms of Service ("Terms") govern your access to and use of ainaemusic.com and any related services, including email and mobile messaging (SMS, MMS, and RCS) offered by Ainae Music ("Ainae," "we," "us," or "our"). By visiting our website, purchasing tickets or merchandise, joining our mailing list, or opting in to receive text or RCS messages, you agree to these Terms. If you do not agree, please do not use our site or messaging programs.

1. Who We Are

Ainae Music is the operating name of the artist Ainae, a Washington, D.C.-based recording and performing artist.

2. Our Services

Through ainaemusic.com and our connected platforms, we offer:

Information about Ainae's music, tour dates, and releases
Ticket sales for live shows (processed via Ticket Tailor)
Merchandise sales (processed via an external Shopify storefront)
Email newsletters and, where you opt in, SMS and RCS text messaging updates
Fan engagement and messaging flows via ManyChat
Community programming under the Free Will movement, including events, workshops, and membership offerings

3. Mobile Messaging Program (SMS & RCS)

If you opt in to receive text messages from Ainae Music, the following terms apply to that messaging program in addition to the rest of these Terms. Full mobile messaging terms are also available in our Privacy Policy under “Mobile Terms of Service.”

By opting in you agree to receive recurring automated promotional and personalized marketing text messages from Ainae Music at the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Consent is not a condition of purchase.

3.1 Program Description

By opting in, you agree to receive recurring automated marketing and informational text messages (SMS/MMS/RCS) from Ainae Music, which may include: new music and release announcements, tour and show updates, ticket on-sale alerts, merchandise drops, abandoned cart reminders, Free Will Weekly event invitations, and membership program updates.

3.2 How to Join

You may opt in by submitting your mobile number through a form on ainaemusic.com, at a live show or event, or by texting a designated keyword to our messaging number. Consent to receive messages is not a condition of any purchase.

3.3 Message Frequency

Message frequency varies and may include up to approximately 4–8 messages per month, depending on tour and release activity.

3.4 Cost

Message and data rates may apply. Charges depend on your mobile carrier and plan.

3.5 How to Opt Out

You can cancel the messaging program at any time. Text STOP to +1 833-903-3361, or reply STOP to any message, to unsubscribe. After you send STOP, we will send one final message confirming your opt-out, and you will receive no further messages from that program unless you opt back in.

3.7 Supported Carriers & Liability

Carriers are not liable for delayed or undelivered messages.

3.8 Privacy

Mobile opt-in information and mobile phone numbers collected for the purposes of SMS/RCS messaging will not be shared with third parties or affiliates for their own marketing or promotional purposes. See our Privacy Policy for full detail on how we collect, use, and protect your information.

4. Purchases

Ticket purchases are subject to the terms of our ticketing provider, Ticket Tailor, at the time of purchase, including refund and exchange policies set by Ainae Music for each event. Merchandise purchases are subject to the terms of our Shopify storefront at the point of sale.

5. Intellectual Property

All music, recordings, videos, photographs, artwork, logos, and written content on ainaemusic.com are the property of Ainae Music or used with permission, and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from this content without prior written permission.

6. User Conduct

When using our site or messaging programs, you agree not to:

Provide false or misleading information, including a phone number or email address that is not your own
Use our services for any unlawful purpose
Attempt to interfere with the security or proper functioning of our site or messaging systems

7. Third-Party Links & Services

Our site and communications may link to or rely on third-party services, including Ticket Tailor, Shopify, Klaviyo, ManyChat, Meta, Instagram, TikTok, YouTube, and Spotify. We are not responsible for the content, privacy practices, or terms of those third-party services.

8. Disclaimer of Warranties

Our website and messaging services are provided "as is" without warranties of any kind, express or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, Ainae Music will not be liable for any indirect, incidental, or consequential damages arising from your use of our website or messaging programs.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or messaging programs after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law principles.
